Seller may take chinchilla back from buyer if buyer can no longer care for the chinchilla, or chinchilla does not work out to buyers advantage. This would be at buyer's expense. Should the seller exercise her Right of First Refusal, buyer will be refunded $100, or half the original purchase price - the lesser of the two amounts.

The seller shall not be responsible for any bodily injuries or property damages caused by the buyer's chinchilla or the actions of the buyer

Chinchildren's warranty obligations are limited to terms set forth: If a chinchilla suffers a health or genetic defect within the first 30 days following the date of delivery, as proven by the written notice of a competent veterinarian or the seller's own examination, a refund or exchange will be issued to the buyer. At its option, Chinchildren will, within six months of the incidence, (1) replace the chinchilla with a chinchilla of equal or lesser value, (2) refund a percentage of the purchase price, (3) refund the full purchase price. Live chinchillas must be returned to the seller for an evaluation to qualify for a refund or exchange. When a chinchilla is exchanged, the new chinchilla issued by the seller becomes the property of the buyer and the exchanged chinchilla becomes the property of the seller. All terms and conditions of this agreement will be transferred to the replacement animal.  If death occurs, buyer must present seller with proof of death such as, but not limited to, the written notice of a veterinarian whose contact information must be provided to the seller. If an autopsy is performed by a veterinarian of the buyer's choice, it is at the expense of the buyer.

CHINCHILDREN DISCLAIMS ANY AND ALL IMPLIED WARRANTIES, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. IF CHINCHILDREN CANNOT LAWFULLY DISCLAIM IMPLIED WARRANTIES UNDER THIS LIMITED WARRANTY, ALL SUCH WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE ARE LIMITED IN DURATION TO THE DURATION OF THIS WARRANTY. CHINCHILDREN IS NOT RESPONSIBLE FOR DIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTAL DAMAGES RESULTING FROM ANY BREACH OF WARRANTY OR CONDITION, OR UNDER ANY OTHER LEGAL THEORY, INCLUDING BUT NOT LIMITED TO LOST PROFITS, GOODWILL, DAMAGE TO OR REPLACEMENT OF PROPERTY.
